AHCA Health Care Clinic Licensing & Exemption

In Florida, ABA therapy providers may be required to obtain a Health Care Clinic (HCC) license from the Agency for Health Care Administration (AHCA) or qualify for a Health Care Clinic Exemption. Navigating these requirements can be complex, especially when dealing with ownership structures, NPI registrations, and payor enrollment timelines. Do You Need an AHCA Health Care Clinic License?

Under Florida law, a license may be required if your organization:

  • Provides health care servics to patients
  • Bills for services under the group/entity
  • Is not wholly owned by DOH licensed health care practitioners
  • Does not meet a statutory exemption category

What’s Required for Licensure?

  • A designated Medical/Clinical Director licensed by the Department of Health

  • Level 2 background screening (as applicable)
  • $2,000 AHCA application fee (paid directly to AHCA)
